Coal miner owner admits to lying to U.S. Court

A leading coal miner owner admitted lying to U.S. regulators, defying a federal judge and defying a trial court by telling an investigation into safety issues that he had safety programs in place to prevent train-derailment accidents.

Blame it on the company lawyers, because the Kentucky Mining Association, which represents coal companies throughout the U.S., told a judge that its spokesman had no obligation to tell the truth under oath.

That story wasn't true. And that mistake wasn't accidental. A judge who was hearing a lawsuit involving a February 2013 coal train derailment near Lyerly, Ky., was so incensed that the KMA's lawyer told a judge he didn't know what he was talking about that she fined the mining association $100,000 for contempt of court. The judge said she was putting the lawyer in a mental health facility.

The coal industry spends millions of dollars every year on PR and lobbying. They don't need to pay fines for lies to the U.S. government or to the courts.

A federal investigation into the 2013 coal train derailment that killed one person and injured 37 led to the largest criminal prosecution of anyone connected to a U.S. coal mine accident in history. It took place at a KMA member mine.

Matthew Eshoo, a lawyer representing train derailer Nathan Johnson, told the federal judge overseeing the case that the coal industry is "fraudulent." Johnson and two other train operators were convicted of misdemeanors and are serving up to 18 months in federal prison for lying to investigators.Q:
